Enforcement (Contempt)
Failure to honor the terms of the judgment or court order is a common problem among divorced couples and unmarried parents of minor children. When a party does not comply with the judgment or order, he or she may be found to be in contempt of court. The contempt may be the failure to pay child support or alimony; the failure to pay uncovered medical bills; the failure to maintain insurance; the refusal to comply with the time-sharing provisions of the Parenting Plan; the failure to convey property or some other failure to comply with the order.
Probably the most common complaint is the failure to pay child support. You should not withhold time-sharing in an effort to make the non-compliant party pay child support. This could result in contempt of court proceedings against you.
Resolving the problem may be as simple as a phone call or letter, but often it will take further action. Verbal sparring with each other is rarely productive and may reflect badly on you and lessen your changes of success. Before things get out of hand you should discuss your situation with an experienced family law attorney. Depending upon the circumstances in your case, the court may even order the non-compliant party to pay your attorneys fees.
